1. Acceptance of Terms

By accessing, browsing or using the Luckendo website located at luckendo-sr.com (the "Platform"), you acknowledge that you have read, understood and agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.

These Terms constitute a legally binding agreement between you ("User", "you" or "your") and Luckendo ("we", "us" or "our"). We reserve the right to update, modify or replace any part of these Terms at our sole discretion. It is your responsibility to review these Terms periodically for changes.

2. Eligibility

The Platform is intended exclusively for individuals who are at least eighteen (18) years of age. By using this Platform, you represent and warrant that you are at least eighteen years old and have the legal capacity to enter into this agreement. If you are under the age of eighteen, you are strictly prohibited from accessing or using the Platform in any manner. We reserve the right to terminate access for any user who is found to be under the minimum age requirement.

We implement an age verification gate that requires users to confirm they meet the minimum age requirement before accessing the Platform. This confirmation is stored locally on your device through your browser's localStorage. No personal identification data is collected or transmitted during this process.

3. Description of Service

Luckendo is a free social entertainment platform that provides browser-based casual games for adults in Canada. All games on the Platform are free entertainment games designed solely for leisure and amusement. The Platform does not facilitate, promote, endorse or involve any form of real money transactions, financial wagering, sweepstakes, prize draws or contests of any kind.

Games on the Platform may include elements of chance such as randomly generated numbers, animated spinning wheels or randomised outcomes. These mechanics exist purely within a free entertainment context and do not constitute any form of financial activity. No purchase or payment is required to access or use any feature on the Platform. The Platform operates without accounts, subscriptions, in-app purchases, premium tiers or paywalls of any kind.

4. Points and Scores Disclaimer

All points, scores, streaks, levels and other in-game metrics available on the Platform are provided solely for entertainment and personal tracking purposes. These virtual items carry absolutely no real-world value and cannot be exchanged, redeemed, transferred, sold, traded or converted into cash, credit, prizes, goods, services or anything of monetary value under any circumstances. Points exist only as a measure of in-game performance and personal achievement within the Platform.

You acknowledge and agree that you have no ownership rights, property interest or entitlement of any kind in or to any points, scores or virtual items associated with your use of the Platform. We reserve the right to modify, reset, adjust or remove points and scoring systems at any time without prior notice and without any obligation to compensate users.

5. User Conduct

When using the Platform, you agree to conduct yourself in a manner that is lawful, respectful and consistent with the intended purpose of the Platform as a free entertainment service. You agree not to use the Platform for any purpose that is unlawful, harmful, threatening, abusive, harassing, defamatory or otherwise objectionable. You further agree not to attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Platform.

6. Prohibited Activities

In connection with your use of the Platform, you are expressly prohibited from engaging in the following activities:

• Using the Platform if you are under the age of eighteen
• Attempting to reverse engineer, decompile, disassemble or otherwise derive the source code of the Platform
• Using automated systems, bots, scrapers or similar technologies to access or interact with the Platform
• Attempting to gain unauthorised access to any portion of the Platform, its servers or any connected systems
• Transmitting any viruses, malware, worms, defects, trojan horses or other items of a destructive nature
• Using the Platform to collect, harvest or store personal data about other users
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity
• Using the Platform in any manner that could damage, disable, overburden or impair its functionality
• Attempting to sell, trade, transfer or assign points, scores or any other in-game metrics to third parties
• Using the Platform for any commercial purpose without our prior written consent

Violation of any of these prohibitions may result in the immediate termination of your access to the Platform.

7. Intellectual Property

All content, materials, features and functionality on the Platform — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, software, data compilations and the overall design and arrangement thereof — are the exclusive property of Luckendo or its licensors and are protected by Canadian and international copyright, trademark, patent, trade secret and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform for personal, non-commercial entertainment purposes only. This licence does not include the right to copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material from the Platform except as incidentally necessary for normal browser operation and personal use.

8. Disclaimer of Warranties

The Platform and all content, materials, information, software, products and services included on or otherwise made available to you through the Platform are provided on an "as is" and "as available" basis without any representations or warranties of any kind, whether express, implied or statutory. To the fullest extent permissible under applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement and title.

We do not warrant that the Platform will be uninterrupted, error-free, secure or free of viruses or other harmful components. We do not warrant the accuracy, reliability, completeness or timeliness of any content, information or materials provided through the Platform. Your use of the Platform is entirely at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Luckendo and its owners, operators, officers, directors, employees, agents, affiliates and licensors shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, use or other intangible losses, arising out of or in connection with your access to, use of or inability to use the Platform, regardless of whether such damages are based on warranty, contract, tort, negligence, strict liability or any other legal theory, and regardless of whether we have been advised of the possibility of such damages.

In no event shall our total cumulative liability to you for all claims arising out of or related to the Platform exceed the amount of ten Canadian dollars (CAD $10.00). This limitation of liability applies to the fullest extent permitted by law in the applicable jurisdiction.

10. Third-Party Links

The Platform may contain links to third-party websites or resources that are not owned or controlled by Luckendo. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third-party websites or resources.

11. Modifications to Terms

We reserve the right to modify, amend or update these Terms at any time and at our sole discretion. When changes are made, we will update the "Last updated" date at the top of this page. Your continued use of the Platform after any such modifications constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, your sole recourse is to discontinue use of the Platform. We encourage you to review these Terms periodically to stay informed of any updates.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Canada and the province in which Luckendo operates, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Canada for the resolution of any disputes arising under or in connection with these Terms.

13. Termination

We reserve the right to restrict, suspend or terminate your access to the Platform at any time, for any reason, without prior notice and without liability. Upon termination, all rights and licences granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination — including but not limited to intellectual property provisions, disclaimers, limitations of liability and governing law — shall survive any termination or expiration of these Terms.

14. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity, legality or enforceability of the remaining provisions of these Terms. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable while preserving its original intent as closely as possible.
